What is a voidable contract?
A voidable contract is a legally-binding contract that can be cancelled by one or both parties if certain conditions are not met. In Hawaii, a contract is voidable when the parties do not have the capacity to enter into the agreement, or when one party has been misled or not given all the relevant information about the agreement. Voidable contracts are also known as “voidable agreements” or “voidable arrangements”. For example, if one party to a contract is not old enough to give consent, then the contract can be voided. Additionally, if one party was not given all the facts about the contract, or if one party was misled into signing a contract, then this can also make the contract voidable. When a contract is voidable, both parties have the right to void the agreement or to enforce it. This means that the person who has been misled, or who is not old enough to give consent, can decide whether to void the contract or accept the terms and conditions of the contract. It is important to understand the laws governing contracts in Hawaii in order to ensure that contracts are binding and that all parties are aware of the terms of the agreement. Without a basic understanding of contract law, parties can be misled or enter into a contract without fully understanding what they’re agreeing to.
