What is rescission of a contract?
Rescission of a contract is a legal concept in Nebraska that allows a contract to be cancelled by either party before it has been completed. This is usually done because of a breach of contract, meaning one of the parties has gone against the terms of the agreement. Once the rescission of the contract has been granted, this means the contract is no longer in effect. Rescission of a contract can be requested by either party if it is found that the contract did not meet the requirements under the law, was entered into under pressure, or was entered into under fraudulent circumstances. In any of these cases, a court may order the rescission of the contract. If one of the parties refuses to follow the court’s orders, the other party may sue for damages. In Nebraska, if one of the parties breaches the terms of the contract, the other may seek a rescission of the contract before going to court. It is important to understand that a rescission of a contract in Nebraska is not the same as a cancellation of a contract. Cancellation of a contract means the contract ends without either party having to take any action. On the other hand, a rescission of a contract requires court orders and is a legally binding action.
