What is a conforming acceptance?

A conforming acceptance is an agreement to the terms of an offer as stated. The buyer must accept all terms of the offer exactly as they are presented and the buyer must not add any additional terms for it to be considered a conforming acceptance. In Texas, if the buyer does not use an explicit acceptance or does add any terms or conditions, it may still be considered a valid acceptance as long as it is not materially different from the original offer. An example of a conforming acceptance would be when a seller offers to sell a car for $10,000 and the buyer responds with an agreement to purchase the car for that price. In this case, the acceptance is conforming and would be considered valid in Texas.
