What is a warranty in a contract?

A warranty is a type of promise made in a contract between two or more parties. It is a promise by one party that certain facts or conditions are true or will be true. In California, when a person or company makes a warranty in a contract, they are guaranteeing that certain facts or conditions are true or will be true and that any goods or services provided will meet specific standards or conditions. A breach of warranty occurs when one of the parties fails to live up to their promise and does not meet the standards set in the contract. For example, if one party promises in a contract that a product they are selling is of a certain quality, they are making a warranty. If the product ends up being of lower quality or not meeting the standards that were promised, the other party can take legal action because the warranty was breached. The most common types of warranties are express warranties, implied warranties, and limited warranties. Express warranties are the most specific, usually written into the contract, and they are promises about the goods or services that are being provided. Implied warranties are less specific and usually not written in the contract but implied through the law. Limited warranties are stated as such in the contract, and state that the goods or services provided will only meet certain conditions for a given period of time. It is important to understand warranties before signing a contract to make sure that both parties are aware of the commitments being made.
