Are there any legal restrictions on civil unions?
In the state of Florida, civil unions are not legally recognized and there are restrictions on civil unions. According to the state’s Attorney General, “Florida law does not recognize civil unions or same-sex marriage. In addition, the Florida Constitution states that a union between only a man and a woman is the only legally recognized marriage in the state.” This means that even if two individuals form a civil union, it is not recognized as a legal union in the state of Florida. There are other restrictions on civil unions as well. For example, if two individuals in a civil union enter into a contract, it’s not legally binding unless both parties agree to its terms. Furthermore, couples in a civil union are not afforded the same legal rights and protections as married couples, such as the right to file joint taxes and the right to inherit from each other without a will. Likewise, any legal process that involves dissolution of a civil union is not recognized in Florida law. This means that the state does not recognize any dissolution of a civil union, whether it’s through divorce or death. There are no laws in the state of Florida that allow for civil unions to be dissolved. In summary, civil unions are not legally recognized in the state of Florida and there are several restrictions on what civil unions are able to do under the law. Couples partaking in a civil union are not afforded the same rights and protections as married couples, and any dissolution of a civil union is not recognized by the state.
