Are civil unions recognized on passport applications?

Civil unions are not recognized on passport applications in South Carolina. Under South Carolina law, a valid civil union is not recognized as being of the same legal status as a marriage. This means that civil unions do not confer any of the legal benefits that are typically associated with marriage. As such, the federal government does not recognize civil unions for the purpose of issuing a passport. In order for an individual to obtain a passport, they must either be married or provide proof of citizenship in the form of a birth certificate, naturalization certificate, or valid driver’s license. If a person is not married, they must provide one of these documents along with another form of government-issued identification in order to apply for a passport. For those in a civil union in South Carolina, the best option when applying for a passport is to provide proof of citizenship and another form of government-issued identification. The civil union will not be recognized when applying for a passport. Although civil unions are not currently recognized by the federal government, it is possible that this could change in the future as marriage laws in the United States continue to evolve.
