Are civil unions recognized for housing benefits?
Civil unions are not currently recognized for housing benefits in Washington. However, that may soon change. In 2018, Washington passed a domestic partnership expansion law, which grants many rights to same-sex couples and domestic partners that are comparable to what is provided to married couples. This law includes certain housing benefits, such as the right to apply jointly to a landlord and the ability to terminate a tenancy without penalty. However, while this law has been passed, the government is still in the process of defining the exact parameters and details of these housing benefits. This has meant that some housing benefits, such as rent subsidies and public housing, have yet to be included in the scope of the law. It is likely that as the law is fleshed out, civil unions will be recognized for housing benefits in Washington. Until then, same-sex couples and domestic partners are not guaranteed any particular housing benefits and must continue to pursue their rights through the court system.
