What is the legal process for dissolving a civil union?
In California, two individuals who wish to dissolve their civil union must file a petition with the court. The petition must provide all the pertinent information, such as the date of the union, why the dissolution is being sought, and a description of any assets held together by the parties. After filing the petition, the parties may need to attend a court hearing to discuss the particulars of their situation and the court will consider any property, financial issues, and child custody matters. The court will review the petition and may require the parties to attend mediation to discuss their disagreements and the potential outcome of the dissolution. The mediation process allows the parties to reach an agreement on the matters of the dissolution and provide a plan for the dissolution of their civil union. Once the mediator has reached an agreement with the parties, or the court has issued a decision on the dissolution, the parties must submit an official dissolution document to the court. The document must include the date of the agreement or court decision, the signature of the parties, and any orders that were issued in regards to the dissolution of the civil union. Once the document is filed with the court, the civil union is officially dissolved.
