What is the legal process for dissolving a civil union?
When a couple decides to dissolve their civil union in North Dakota, they must go through a legal process outlined by state law. To begin with, both individuals must decide to end the union. If one partner wishes to remain in the union, the other may need to obtain a court order to end the civil union. Once the decision to dissolve the civil union has been made, the individual that files the paperwork is referred to as the “petitioner.” The petitioner must complete the necessary forms and documents, including a Petition for Dissolution of Civil Union. After the paperwork is complete, the petitioner will need to file the documents with the court. At the same time, the petitioner must serve a copy of the Petition on the other partner. When the court receives the Petition, it will schedule a hearing and notify both partners. During the hearing, the court may ask the two parties to provide proof of the dissolution of the civil union, such as a written statement from either partner or a witness. After the hearing is complete, the court will issue an order to dissolve the civil union. Once the dissolution of the civil union is finalized, the two parties are no longer legally bound to one another and the civil union is officially terminated. It is important to note that the court does not provide any assistance with the division of property or other assets, so both partners should come to an agreement on these matters prior to the hearing.
