How do I terminate a civil union?
In Oklahoma, terminating a civil union is a legally-binding process. It is important to note that there is no formal process for dissolving a civil union, as there is for a marriage. The only way to end a civil union is to go to court. To terminate a civil union, one must file a Petition for Dissolution with the court. The petition should state the reasons why the couple wishes to end the union. The other partner must be given the chance to respond and present their side of the story. If the couple agrees on how to divide their assets and debts, the court may enter an Order of Dissolution that reflects the agreement. If the parties can’t reach an agreement, the court may enter a Judgment of Dissolution that follows Oklahoma state law. Once the court enters an Order or Judgment of Dissolution, the partners are no longer in a civil union and any rights or obligations they had due to the union are extinguished. The parties may seek an Order of Protection to prohibit the other party from coming around or otherwise contacting them if necessary. It’s important to note that, as with any legal process, it is best to consult with a family law attorney to ensure that the process is done correctly and that all parties are treated fairly.
