Are there any requirements for proving a civil union in court?
In West Virginia, if a couple wishes to prove that they are in a civil union, they must meet certain legal requirements. These requirements are outlined in West Virginia Code § 48-3-102. In order for a civil union to be proven in court, the couple must provide a valid civil union license issued by the court or by the clerk of the county in which the civil union was entered into. This license must be signed by both parties and include their names, addresses and the county in which the civil union was entered into. Additionally, the couple may provide testimony from at least one witness who can attest to their living together and their intent to be in a civil union. Evidence of shared assets, such as financial accounts or jointly owned property, is also acceptable in court as proof of a civil union. The couple can also provide documentation of bills or other expenses that have been paid jointly and any other documents that support their claim of being in a civil union. All of this evidence must be provided before the court can accept the civil union as valid. If the court determines that the evidence presented is insufficient to prove the existence of a valid civil union, the court may require the couple to provide additional proof before the civil union can be deemed valid.
