What are the legal consequences of entering into a civil union?
When two people enter into a civil union, or a “reciprocal beneficiary relationship”, in the state of Georgia, they become legally bound to each other. This means they have certain rights and responsibilities in regards to one another. The most important consequence of entering into a civil union is that the couple can enjoy the same rights and benefits that a married couple does. This includes having insurance coverage through the other person’s job, joint ownership of property, legal authority to make decisions about the other’s health and finances, making joint tax returns, and having the same legal standing in adoption, inheritance and other legal matters. At the same time, the couple will also have the same obligations as married spouses. This means that if the couple separates, they may have to divide property and assets, pay spousal support and/or child support, and comply with other legal requirements related to separation or divorce. Additionally, there may be legal consequences for couples who enter into a civil union but not a marriage. For example, the couple may not be eligible for certain government benefits, or for certain tax deductions. Couples should make sure to research their options thoroughly before entering into a civil union to avoid any surprises down the road.
