Is a civil union recognized by the federal government?

No, civil unions are not currently recognized by the federal government. In Oklahoma, civil unions are not recognized as a legal form of marriage that is equal to a marriage license. Currently in Oklahoma, civil unions are formed under the state’s law, but do not have the same rights and privileges as those who are married. Civil unions are similar to marriages in that parties to a civil union receive some of the same benefits as a married couple. These benefits may include some legal rights when it comes to tax status, power of attorney, and hospital visitation. However, these civil union benefits are only applicable within the state of Oklahoma and are not recognized by the federal government. Under the 1996 Defense of Marriage Act (DOMA), the federal government does not recognize any same-sex marriage or civil union. DOMA defines marriage as only between a man and a woman, thus civil unions are not recognized at the federal level. In Oklahoma, a civil union must be legally formed by both parties signing a civil union agreement and a notary public witnessing the signing. The notarized document must then be filed with the court clerk in the county where the civil union is held. At this time, the state of Oklahoma does not have any statutory provisions that provide equal rights and benefits to civil union couples as those provided to married couples.
