What is a civil fraud investigation?

A civil fraud investigation is a investigation conducted in order to determine whether an individual or business has committed fraud. Fraud is an intentional act that involves deceiving or misleading another party for personal or financial gain. In Florida, civil fraud investigations are often conducted by the Division of Financial Services, a bureau of the Florida Department of Financial Services. The Division of Financial Services is responsible for investigating various types of financial fraud, including insurance fraud, consumer fraud, investment fraud, and identify theft. When conducting a civil fraud investigation, the Division of Financial Services may gather evidence, interview witnesses, and review documents. If the investigation finds that fraud has occurred, the Division of Financial Services may bring a civil lawsuit against the guilty party or parties. The lawsuit may seek restitution, criminal penalties, and/or civil penalties. The guilty person may be required to pay back any money obtained through fraudulent activities as well as fines and/or other penalties. In addition to criminal penalties, there may be civil penalties for civil fraud. Civil penalties may include a fine of up to $10,000, imprisonment of up to five years, or both. Civil fraud investigations can also lead to civil punishments, such as being required to pay restitution to those affected by the fraud or being barred from engaging in certain types of business activities in the future.
