What is the difference between civil fraud and common law fraud?

Civil fraud and common law fraud are two distinct types of fraud in the state of Florida. Civil fraud is considered a tort, or an act that causes harm to a person or their property. A tort is a civil wrong, and in the case of civil fraud, is a wrongful act that interferes with another person’s right to financial or economic security. In addition, the person committing the act of civil fraud must have had knowledge or intent that their actions were wrong when they took them. Common law fraud, on the other hand, is committed when a person misrepresents a material fact, or important fact, to another person. Unlike civil fraud, a person committing common law fraud does not necessarily need to have knowledge of intent of harm, as it is a criminal offense. The person committing the act of fraud must have made the misrepresentation knowing it was false and with the intent of deceiving the other person or party. In sum, civil fraud and common law fraud are two distinct types of fraud in the state of Florida. Civil fraud is considered a tort, whereas common law fraud is a criminal offense.
