What is the difference between civil fraud and tortious interference?
Civil fraud and tortious interference are two distinct types of civil wrongs in West Virginia. Civil fraud is a type of claim where a party deliberately lies to another party to bring about a financial benefit. The party must know that the false statement is untrue, and it must be made with the intention of financial gain. When a person is the victim of civil fraud, the court will often award financial damages to make up for the financial losses. Tortious interference, also known as intentional interference with a contractual relationship, is a civil wrong where one party deliberately interferes with the contractual or business relationship of another. Unlike with civil fraud, the party does not need to make a false statement. Examples of tortious interference include inducing someone to break a contract, inducing someone else not to enter into a contract, or using economic pressure to discourage a party from entering into a contract or business relationship. The party who is the victim of tortious interference can usually seek both compensatory damages for their losses, as well as punitive damages to prevent similar conduct in the future. In general, the primary difference between civil fraud and tortious interference is the type of conduct that is involved. In civil fraud, the wrongdoer makes a false statement, while in tortious interference, the wrongdoer interferes with a contractual or business relationship. Both types of civil wrongs can result in significant financial losses, and a court can order damages from the wrongdoer.
