What is the difference between civil fraud and misrepresentation?

Civil fraud and misrepresentation are both important terms in civil law in West Virginia. Both terms have to do with deception and relate to the legal concept of contract law. Civil fraud is a more serious civil offense than misrepresentation. It occurs when a person intentionally deceives another person or entity into signing a contract or agreement that involves a financial gain for the deceiver. In civil fraud, the deceiver engages in a serious form of deceit that goes beyond simply making false statements. The deceiver may use lies, false documents, or other methods to mislead the victim. If a contract or agreement is found to have resulted from civil fraud, the court may order restitution, monetary damages, or other forms of relief. Misrepresentation, on the other hand, is a less serious civil offense than fraud. It occurs when a person misrepresents facts with the intent to mislead another person or entity, but not necessarily to gain a financial benefit. Misrepresentation can involve false statements, but it does not require an act of deceit as serious as civil fraud. If a court finds that a contract or agreement was based on misrepresentation, it may order restitution, damages, or other forms of relief depending on the severity of the offense. In summary, civil fraud is a more serious form of deceit than misrepresentation and requires intent to mislead another person in order to gain a financial benefit. Misrepresentation, on the other hand, exists when a person misrepresents facts with the intention of misleading another person, but not necessarily to gain a financial benefit.
