What is the appeals process?

The appeals process in Mississippi is the process for resolving disputes in civil cases. It is a process that is often used when a party believes that errors of law were made in the trial court. The steps in the Mississippi appeals process are generally the same in most civil cases. First, the appellant (the party filing the appeal) must file a Notice of Appeal in the trial court. The Notice of Appeal spells out the issues that the appellant intends to challenge on appeal. Once the Notice of Appeal is filed, the case is assigned to an appellate court. In the appellate court, the appellant and the appellee (the party defending the appeal) submit written briefs to the court with their respective positions on the appeal. In some cases, both parties will have an oral argument in the appellate court. The appellate court will then review the record and determine whether errors of law were made in the trial court. If the appellate court finds that errors were made in the trial court, the court will either reverse or modify the decision of the trial court. If the appellate court affirms the decision of the trial court, then the decision of the trial court stands as the final ruling. If either party is unsatisfied with the decision of the appellate court, they may appeal the decision to the Mississippi Supreme Court. The Supreme Court has the power to reverse the decision of the appellate court if it finds that the decision was in error. The appeals process ends with the decision of the Mississippi Supreme Court.
