What are the remedies for civil actions?

In Kansas, there are a variety of remedies available to the winning party in a civil action. A remedy is a government-enforced solution that provides compensation to those affected by a legal action. Some of the most common remedies in civil cases are damages awards, injunctions, and declaratory judgments. An award of damages compensates the party harmed by the wrong that was done. Injunctions are court orders prohibiting a party from taking certain actions, such as not allowing a landlord to evict a tenant. Declaratory judgments are court orders declaring the rights and obligations of each party in a legal action. In some cases, a court may also order specific performance, where a court requires a person to do something they had promised to do under a contract. Punitive damages may also be awarded in some cases, if the court finds that the defendant has acted with extreme recklessness, malice, or fraud. Punitive damages are designed to punish the defendant and discourage them from repeating the same action. In addition to these remedies, courts may also order restitution, restitutionary disgorgements, and equitable remedies. Restitution requires a defendant to return something to the plaintiff that was taken away. Restitutionary disgorgements require a defendant to disgorge or return profits they made from an illegal transaction. Equitable remedies involve the court ordering a remedy to achieve fairness, such as ordering the return of property, canceling a contract, or ordering the defendant to pay the plaintiff’s legal fees.
