What is a motion to change venue?
A motion to change venue is a request to move the legal case from one court to another. In Nebraska, a motion to change venue is usually made when there is an issue of local prejudice against the parties involved or the case itself. For example, if the plaintiff is from a different county than the defendant, a motion to change venue might be requested to ensure that the parties receive a fair and impartial trial. The motion must be filed in the court that the parties are currently in, and must cite a legal reason for why the trial should be moved. A party may waive their right to a motion to change venue, however, by agreeing to have the trial conducted in another court and at another place. After the motion to change venue is filed, the other parties involved in the case will be notified. They have an opportunity to respond to the motion within a certain amount of time. The court then has the discretion to deny or accept the motion, depending on the grounds given. If the court grants the motion to change venue, the case will be transferred from the original court to the court of the requested new venue. The parties and witnesses must then appear in the new court to continue the trial.
