What is a motion to intervene?

A motion to intervene is a legal request that asks for permission to become involved in a lawsuit. In Arkansas, a person wishing to intervene in a civil lawsuit must file a motion to intervene with the court. The motion to intervene must explain why the person wants to get involved in the lawsuit and how it is relevant to the case. A motion to intervene allows someone not originally named as a party in the lawsuit to become a part of the proceedings in civil court. This could be useful if the person has an interest in the outcome of the case or believes they may be impacted by the outcome. For example, a business who may be affected by the outcome of a dispute between two of its consumers may decide to intervene in the case. Often, a motion to intervene is filed by a non-party who wishes to file a claim that is similar to issues already being litigated. The court may decide to deny the motion to intervene if the person seeking to intervene does not have a “direct and substantial” interest in the case or if the intervention would disrupt or delay the progress of the case. Therefore, if a person wants to intervene in a civil case in Arkansas, they must file a motion to intervene that explains why they have an interest in the case and how it could be relevant to the outcome.
