Filing a civil rights complaint in North Dakota can be done by following the guidelines outlined by the North Dakota Department of Labor and Human Rights (NDDOLHR). The first step is to complete the “Civil Rights Complaint Form”, which is available on the public services page of the NDDOLHR website. This form can be completed online or printed and mailed to the Civil Rights Division at the NDDOLHR. Once the complaint form is completed and submitted, a thorough review of the complaint will be done by either a staff member or a special investigator. The review of the complaint will determine if the complaint has enough information to qualify as a civil rights claim. If the complaint is found to have sufficient information, the complaint will be formally investigated. The investigation of the complaint may involve interviewing witnesses or the collection of other evidence, such as documents or photographs. Depending on the outcome of the investigation, the Department of Labor and Human Rights may decide to pursue a settlement, refer the complaint to a court or to another governmental agency, or dismiss the complaint. If the Department of Labor and Human Rights determines that the complaint is valid, they can decide to pursue civil rights enforcement measures against the violator, including ordering injunctions, ordering compensation for the victim, or filing a civil lawsuit. Whether or not the complaint is found to be valid, individuals who have filed a complaint have the right to appeal the outcome of the investigation. This appeal must be made within 30 days of the decision and must be made in writing.
