What is the legal definition of sexual harassment?

Sexual harassment is a type of civil rights law in Texas that is defined as any unwelcome sexual advances, requests for sexual favors, or other verbal or physical conduct of a sexual nature. This includes any conduct or behavior that creates an intimidating, hostile, or offensive working or educational environment for an individual or group. It is important to note that sexual harassment also can include non-verbal behaviors, such as inappropriate jokes, comments, and gestures that are directed at someone’s gender or sexual orientation. Additionally, sexual harassment includes any conduct that is based on gender stereotypes or that adversely affects a person’s employment or educational opportunities because of their gender. In Texas, it is illegal for employers and educational institutions to allow any type of sexual harassment in the workplace or classroom. This means an employer must take steps to prevent or stop any sexual harassment that they become aware of and must also properly respond to any complaints of sexual harassment. Any person who experiences sexual harassment in the workplace or educational setting may be able to make a claim for damages, including both economic and non-economic damages.
