How does cybersecurity law address cyberbullying?

Cybersecurity law in Indiana addresses cyberbullying in a few distinct ways. First, cyberbullying is considered a crime in the state of Indiana and is punishable by law. According to Indiana Code 35-45-4-3, cyberbullying can be charged as a Class A misdemeanor if it causes harm to the victim. Indiana Code 35-45-10-1 also makes it a crime to use the internet to threaten someone or cause them distress. Secondly, Indiana has enacted laws to help protect children from cyberbullying. According to Indiana Code 35-45-10-2, it is illegal to send any type of electronic communication or post any type of comment that is deemed intimidating or alarming. Furthermore, Indiana Code 35-45-10-3 makes it illegal for any person to send any type of threatening or harassing electronic communication with malicious intent. Finally, Indiana has several laws that create protocols for schools to address cyberbullying. Indiana Code 20-33-8-16.5 outlines the protocols that school corporations must have in place to address bullying in general, including cyberbullying. This statute requires that the schools create a way for students to report any incidents of cyberbullying, and it also requires that the schools investigate any incidents that are reported. All these laws in Indiana work together to help protect individuals from cyberbullying. By taking a firm stance against cyberbullying, these laws send a message to potential offenders that this type of behavior will not be tolerated, and those who engage in it will face consequences.
