What is the legal framework for monitoring employee computers and data?
In Mississippi, employers have legal rights to monitor their employee computers and data. Generally speaking, it is not necessary to obtain the consent of the employee prior to monitoring their data. Employers should, however, provide notice to their employees that they may be monitored and the type of data that may be collected. Under Mississippi law, employers may monitor employee communications, including emails, social media accounts, and internet activity. Employers are also allowed to monitor employee computers and data, including files stored on the computer, emails, internet browsing and activity on company networks. Mississippi employers may also collect information stored on a computer, such as what programs and apps are installed, the applications used, and the documents accessed on the computer. Employers are also allowed to take screen shots of the employee’s computer screen, for the purpose of monitoring activity. The monitoring of employee computers and data must comply with any applicable state or federal laws, such as those protecting employee privacy and personal data. Employers should also adhere to any other contractual agreements with employees that may limit the scope of employee monitoring. Ultimately, employers should use reasonable and necessary measures to protect their business and ensure the safety and security of their employees and data.
