What are the legal requirements for data breach notification?

In Idaho, businesses and government entities covered by cyber security law must provide notification of a data breach within 45 days of discovering the breach. The notification must include the identity and contact information of those affected, as well as a description of the type of data that was disclosed. Additionally, the notification must provide information regarding the steps taken by the organization to mitigate the harm from the breach and to safeguard the affected customers’ data. Businesses must also inform any consumer credit reporting agencies of data breaches that involve Social Security numbers, credit/debit card numbers, or other personal financial information. Furthermore, these organizations must provide a toll-free customer service number for affected customers to call and get help in responding to the breach. Finally, businesses must send notifications to the Idaho Attorney General’s Office and the Idaho Department of Financial Institutions if a breach affects more than 250 residents in the state. This notification must contain all of the information noted above, as well as a description of any corrective action taken to prevent similar breaches in the future.
