What are the legal requirements for disclosing data breaches?

In Wisconsin, business and organizations are legally required to disclose when a data breach has occurred. This means releasing information to the public about what has happened and how it may affect individuals. Under the Wisconsin Security of Personal Information Statutes, any business or organization that collects and stores personal information on individuals must notify those individuals if their information has been compromised. This notification must occur no later than 45 days after the breach has been discovered. The notification must include information on what happened, what information was compromised and what actions individuals can take in order to protect their data. The notification must also include contact information for the organization or business in order to provide additional support. Organizations must also notify the Wisconsin Department of Agriculture, Trade and Consumer Protection if more than 250 individuals were affected by the breach. The notification must take place no more than 45 days after the breach was discovered and must include the same information included in the individual notifications. Organizations and businesses must also take appropriate measures to protect any personal information they have collected. This may involve implementing security protocols, encrypting data and conducting regular assessments of security measures. Failure to comply with the legal requirements for data breaches may result in hefty fines.
