When can I file a claim under Dangerous Products Law?

Under New York law, if you have been injured because of a dangerous product, you can file a claim for damages. Generally speaking, any claim for damages must be brought within three years of the date of the injury. However, if the product was sold, given away or offered for sale in the state, the three-year statute of limitations does not apply. The key to successful recovery of damages under Dangerous Products Law is to prove that the manufacturer or seller of the dangerous product is responsible for the harm caused. This can be done through evidence such as product specifications, laboratory or medical reports, testimonies of witnesses, and other evidence demonstrating the product was defective or unreasonably dangerous. A successful claim may result in compensation for medical expenses, lost income, pain and suffering, and other harms suffered. In addition, under the Dangerous Products Law, punitive damages may be awarded if it is found that the defendant acted with intentional or reckless disregard for the safety of the consumer. It is important to note that if a claim is filed after the three-year period has passed, the plaintiff may not be able to recover damages, so it is important to file the claim as soon as possible. Further, it is crucial to consult an attorney with experience in Dangerous Products Law in order to maximize the potential recovery.
