What is a breach of warranty?

A breach of warranty is a legal term that is used in the state of Maryland when there is a violation of the terms of a product’s warranty. A warranty is a written agreement that is made between a manufacturer or seller and a buyer of a product. It states that the product will meet certain standards of quality, performance, and durability, and that any defects or damages to it will be taken care of by the manufacturer. When the manufacturer does not fulfill the warranty agreement, they are said to have breached the warranty. This could happen if the product does not perform as promised, or if the manufacturer does not repair it when it is damaged. In this case, the buyer may be able to take legal action against the manufacturer. The Maryland Dangerous Products Law allows buyers to file a lawsuit if they have suffered financial losses as a result of a breach of warranty. Additionally, the law states that the buyer may also be entitled to compensation if they have experienced physical injury or property damage as a result of the breach of warranty. It is important to note that the burden of proof lies with the buyer, so they will need to provide evidence that the product failed to meet the standards set out in the warranty agreement.
