What are the statutes of limitations governing product liability claims?

In Arizona, the statutes of limitations governing product liability claims are found in Arizona Revised Statute 12-548. These statutes outline the time period in which a person may file a product liability claim. Generally, these statutes stipulate that an individual must file the lawsuit within two years after the injury occurred, or within two years of when the individual discovered the injury. In addition to the two-year general limitation period, it is important to note that a claim under A.R.S 12-548 will be barred eight years after the date of sale of the product. Therefore, any product liability claim filed over eight years after the date of sale of the product will be void. Moreover, a statute of repose is also in place for medical device and drug claims. The statute of repose states that a suit based on a medical device or drug must be brought within the earlier of 10 years after the date of sale of the device or drug, or 10 years after it was initially implanted into or administered to the plaintiff. Overall, Arizona has multiple statutes of limitations surrounding product liability claims. It is important to understand each of these statutes in order to know how long an individual has to legally file a product liability claim. It is recommended that individuals with claims seek legal counsel in order to make sure they are properly informed and within the time period of limitations for their claim.
