What are the elements of a product liability claim?

A product liability claim in Nevada is a type of legal action that can be taken against the manufacturer, distributor, or seller of a product when that product causes harm to an individual. In order to bring a successful claim, three elements must be established. First, the claimant must prove that there was a defect in the product. This can be a design defect, meaning the product was not designed correctly and it caused harm, a manufacturing defect, meaning something went wrong during the manufacturing process and caused a dangerous product, or a warning defect, meaning the warnings on the product were inadequate and caused harm. Second, the claimant must prove that there was an actual injury, illness, or other form of harm caused by the product. This could be physical harms such as burns or lacerations as well as psychological harms such as emotional distress. Finally, the claimant must demonstrate that the injury or harm was a result of using or coming into contact with the defective product. The claimant must show a direct cause and effect between the product and the harm. If all three of these elements are present, then the claimant can successfully prove a product liability claim in Nevada.
