What types of products have a higher risk of causing injury?
Products which have a higher risk of causing injury in Utah generally include those which are inherently dangerous and can become dangerous in certain circumstances. These include products such as firearms, toxic chemicals (e.g. gasoline, household cleaners, pesticides, and other hazardous materials), flammable materials, and machinery such as lawn mowers and power tools. In addition, some products are considered dangerous because they have the potential to cause injury when used incorrectly, or due to a defect or design flaw. Examples of these types of dangerous products can include cars and trucks, medical equipment, consumer electronics, toys, and certain household items such as ladders, stairs, and furniture. Under Dangerous Products Law in Utah, manufacturers and sellers of dangerous products can be held liable for the injuries they cause. If a product is sold or distributed knowing that it poses a risk of injury, its seller can be held liable for any resulting harm. Additionally, manufacturers can be held liable for the design and production of a hazardous product, even if the product was sold without defect or warning.
