What is a manufacturing defect?

A manufacturing defect is a product defect that exists at the time the product is produced. It occurs when an item does not meet the quality standards the manufacturer set. In other words, the product is made incorrectly. A manufacturing defect can be due to a flaw in the design of the product or a mistake that occurred when it was produced. In South Carolina, a manufacturer can be held liable for any injury that occurs due to a manufacturing defect. In general, the injured party must prove two things: that the product had a defect when it was purchased and that the defect caused the injury. The party being sued may argue that the injured party was not using the product as it was intended to be used, which could also be a factor in determining who is at fault. In addition, the manufacturer may argue that the product was not properly maintained or used in an unsafe manner. Manufacturing defects in South Carolina are regulated by the South Carolina Dangerous Products Law, which requires manufacturers to provide safe products to the public. The law also states that a manufacturer must be held liable for any injuries caused by a defective product that was manufactured by them.
