What is a failure to warn claim?
A failure to warn claim is a type of legal claim that can be brought against a company in Kansas under the state’s Dangerous Products Law. A failure to warn claim occurs when a company does not provide sufficient warning about potential hazards related to a product they are selling. This type of claim can be filed by a person who was injured due to the use of a product or by a family member of a person who was injured or killed because of a product’s failure to adequately warn of potential hazards. In order to succeed in a failure to warn claim, the plaintiff must prove that the defendant had a duty to warn about the potential hazard and that they failed to do so. The plaintiff must also prove that they were injured by the product as a result of the failure to warn. It is also very important to show that the company had the knowledge and ability to warn customers about the risks associated with the product but failed to do so. Under the Kansas Dangerous Products Law, victims of a failure to warn claim may be entitled to financial compensation related to medical expenses, lost wages, and pain and suffering. It is important to note that the burden of proof lies with the plaintiff in these cases and that the defendant must be able to show that they took reasonable steps to warn customers of potential risks.
