What is the liability of a seller or distributor of a product?
In North Dakota, sellers and distributors of products are liable for any damages resulting from a dangerous or defective product. This includes direct and third-party liability if a product is sold or distributed with the knowledge that it is dangerous or defective and causes harm to someone. If the product is sold without knowledge of its dangerous or defective condition, then the seller or distributor is still liable if an injury or death occurs due to the product being sold in a defective condition. Sellers and distributors may also be liable for economic losses resulting from the use of a dangerous or defective product. This can include property damage, medical bills, lost wages and other associated costs. Under North Dakota’s dangerous products law, the seller or distributor of a product must be held accountable for any harm experienced by a consumer due to the product’s dangerous or defective condition. Sellers and distributors may be able to avoid liability if they can prove that proper inspection and testing procedures were followed prior to selling the product. This includes demonstrating that the product was of merchantable quality and not unreasonably dangerous or defective. Furthermore, if a warning label has been placed on the product or the seller has provided specific instructions for its use, this may provide the seller or distributor with some protection against liability.
