What is a defective product recall?
A defective product recall is a formal request by a manufacturer to return a product that is deemed dangerous or defective. This can be done voluntarily by the manufacturer or through a court order issued by a regulatory agency. In New Hampshire, the Agency of Consumer Protection within the Office of the Attorney General is the agency responsible for regulating and enforcing the state’s product safety laws. When a product is found to be defective or dangerous, the manufacturer may issue a recall of the product in an attempt to protect consumers from injury or harm. During a product recall, the manufacturer will contact all customers who have purchased the product to inform them of the safety risk and request they return the product to the manufacturer for replacement or repair. It is important to note that a product may be recalled even if it has not caused any injury yet. The manufacturer will usually issue a recall before any injury occurs as a preventative measure or to fix a small problem before it becomes a bigger issue. In New Hampshire, a defective product recall is subject to the state’s Dangerous Products Law which requires manufacturers to take responsibility for any injuries caused by their products and to take reasonable steps to inform customers if a product is found to be defective or dangerous.
