What is a defective product recall?

A defective product recall is a process by which a company or government entity removes a product from the market due to it being found to be unsafe, defective, or hazardous. The recall process is initiated when a product is identified to have a defect that could cause serious injury or death. The company responsible for the product is then required by law to issue a recall to all distributors, retailers, or customers that may have purchased the product, as well as any other party that may have been exposed to the product’s risk. The North Carolina Department of Agriculture (NCDA) is responsible for overseeing recall of defective products in the state. Companies have a legal obligation to inform the NCDA as soon as they become aware of a defective product, and the NCDA will then work with them to initiate a recall. This can include both voluntary recalls initiated by the company, and mandatory recalls issued by the NCDA. In either case, the company is obligated to provide appropriate remedies for their customers such as replacement, refunds, or repairs. In addition to issuing a recall, companies must take steps to ensure that the defective product is disposed of safely and is not reused, especially if it could cause serious harm to consumers. The NCDA has the authority to inspect companies to ensure that they are following the law, and failure to do so could result in fines or criminal charges. All of this serves to protect North Carolina consumers from dangerous products that could put them at risk.
