What are the possible remedies in a product liability case?
In an Oklahoma product liability case, a consumer may have a variety of remedies available, depending on the circumstances. Generally speaking, these remedies can include money damages, repair or replacement of the product, and/or injunctive relief, among other possible remedies. Money damages can include compensatory and punitive damages, depending on the facts of the case. Compensatory damages are designed to compensate a consumer for the losses they suffered due to the product. These may include both economic losses (such as medical bills associated with injury) and non-economic losses (such as pain and suffering). Punitive damages, on the other hand, are designed to punish a company whose conduct was deemed especially reckless or negligent, in order to deter other companies from acting similarly. If the product is still intact, the consumer may also be able to secure relief in the form of repair or replacement of the product. This can be at the company’s expense, thus providing a cost-effective remedy for the consumer. Finally, the court may grant injunctive relief, which is an order from the court requiring the company to take some action. This can be an especially useful remedy in cases involving defective products that are still on the market, to ensure that no more consumers suffer the harm the defective product has already caused. Overall, there are numerous remedies available to consumers in an Oklahoma product liability case. Depending on the facts of the case, a consumer may be able to recover compensatory and/or punitive damages, secure replacement or repair of the product, or obtain injunctive relief from the court.
