What is “strict liability”?

Strict liability is a legal term referring to a product liability law in which a manufacturer or seller of a product is held legally responsible for any damages or injuries caused by their product, regardless of fault or negligence. In the state of South Carolina, it is applicable with Dangerous Products Law. Strict liability is a form of civil liability, meaning that it is a legal responsibility for damages from a product that are not caused by any fault or negligence of the manufacturer. Even if the manufacturer took all the necessary safety precautions, they will still be held liable if the product causes any harm. For the manufacturer to be held strictly liable, the court must prove that the product had a defect when it left the maker or seller’s possession and that the defect was the cause of the injury or damage. If a consumer can prove that the product was defective and the defect caused the injury, the manufacturer is liable and can be required to pay damages. Overall, strict liability is a form of civil law that poses significant responsibility on the product manufacturer or seller. It is important to note that with strict liability, the manufacturer is liable regardless if they were aware of the defect or not. As such, consumers can feel more secure knowing that their rights are protected in case they are injured due to a defective product.
