What is a warning label defense?

In New York, a warning label defense is a legal defense used in product liability cases. This defense is used by a manufacturer or seller of a product who is being sued for a dangerous product-related injury. The defense asserts that the product was accompanied by a warning label, which was prominent and sufficiently informed consumers of the dangers associated with the product. The defense argues that the warning label should shield the manufacturer or seller from responsibility for any damage caused by the product. The warning label defense is based on the idea that a consumer should be informed of any potential risks associated with a product before they use it. If the manufacturer or seller provides a warning label that is clear and noticeable, then it is assumed that the consumer was informed of any dangers. Additionally, if the warning label was prominent enough to be seen, it is assumed that the consumer had ample time to read and understand it. The warning label defense is not applicable in all cases. A warning label may not be adequate if the product is inherently dangerous or if the warning label was not visible or conspicuous enough. Also, if the warning label does not accurately describe the dangers associated with the product, it may not be enough for a defendant to use the warning label defense. It is ultimately the responsibility of the court to determine whether or not a warning label defense is valid in a product liability case.
