What is a warning defect?
A warning defect is a type of product defect in California where there was not adequate warning of a potential hazard associated with the product. This defect typically covers cases where the product did not contain a warning label that would alert consumers to the potential danger of the product. For example, if a product contained a chemical that could cause serious burns or eye damage if mishandled, then a warning label should be placed on the product to alert consumers to the potential danger. Warning defects also cover cases where the warning label was inadequate in informing consumers of the potential risk. For example, if the warning label on a product failed to mention that it should be used with caution, or that it could cause serious injury if mishandled, then it would be considered a warning defect. The California Dangerous Products Law is designed to protect consumers from dangerous products and to hold the manufacturers accountable for any injuries that occur as a result of a warning defect. Manufacturers are required to provide adequate warnings about the potential danger of their products and failure to do so could result in civil liability for any injuries that occur as a result of a warning defect.
