What is a warning defect?
A warning defect is a type of legal liability found in Dangerous Products Law in Kansas. It occurs when a manufacturer or seller fails to warn consumers of a dangerous or potentially hazardous condition of a product. This means that a manufacturer or seller has an obligation to adequately warn consumers about any risks posed by the product and any instructions necessary for its safe use, even if the product may appear to be safe at the time of sale. In Kansas, the law requires a warning defect claim to be proven by showing a relationship between the manufacturer or seller’s negligence and the harm caused to the consumer. This means that the plaintiff must prove that the manufacturer or seller did not provide a warning or did not provide an adequate warning of the danger or risk posed by the product. The plaintiff must also show that the lack of warning was the direct and proximate cause of the harm suffered, such as illness, injury, or death. Additionally, if the manufacturer or seller had previously discovered the risk associated with the product and failed to warn consumers, they may be liable for any resulting damages. In such cases, it is the plaintiff’s responsibility to prove that the seller or manufacturer deliberately concealed or failed to disclose the danger. In order for a warning defect claim to be successful, the plaintiff must prove all elements of the claim, including the existence of a duty to warn, the breach of duty, causation, and damages to the plaintiff. It is recommended that anyone wishing to pursue a warning defect claim in Kansas consult with an experienced lawyer in order to ensure that all of the necessary evidence is provided to the court.
