What is a marketing defect?

A marketing defect is a type of product defect that occurs when a product is inaccurately or inadequately advertised or labeled. It is an issue with the presentation of a product rather than with the actual product itself. In Washington, the Dangerous Products Law requires that products are accurately labeled and marketed in a safe manner. If a product is found to have a marketing defect, it can be classified as a dangerous product. For example, if a product is marketed as being safe for children to use but actually contains hazardous materials, it would be considered to have a marketing defect. When a product has a marketing defect, the seller can be held liable for any injuries that occur from use of the product. For example, if a family purchased a product marketed as having no harmful substances for their children, but the product contained dangerous substances, the seller could be held responsible for any injuries the children sustained. It is important for sellers to ensure that the products they are marketing are accurately labeled and presented in a safe manner, in order to avoid any potential legal issues and protect consumers from harm.
