What is a “misuse” defense to a product liability claim?
A “misuse” defense to a product liability claim is a legal defense available in California which states that a manufacturer or distributor cannot be held liable for a defective product if its misuse was the direct cause of a consumer’s injury. This defense does not require any proof that the product was defective, only that the product was used in an unsafe manner, and that the misuse was the direct cause of the injury. For example, let’s say you purchase a chainsaw and injure yourself while using it. You can’t hold the manufacturer liable because your misuse of the product is considered the direct cause of your injury. The manufacturer may be able to argue that you didn’t read the product’s instructions, or that you disregarded the safety guidelines. This defense is beneficial to manufacturers because it limits their liability for faulty products that may harm consumers. However, it should be noted that this defense isn’t always successful. The courts will always evaluate the facts of the case to determine whether the misuse defense applies. If there is sufficient evidence that a product was defective or that a manufacturer or distributor has acted negligently, then the defense may be unsuccessful.
