What are the different types of product liability claims?

Product liability claims are legal arguments that a defective product has caused injury or harm to a person. These claims can be divided into three broad categories: design defects, manufacturing defects, and failure to warn. Design defects refer to flaws in the design of a product that can cause it to be dangerously unsafe. An example of this type of claim may be a vehicle with defective brakes that causes an accident. Manufacturing defects occur when the product is unintentionally made differently than what is stated in the design. For example, when a toy is made with hazardous materials, this could create a risk of injury to a child. Failure to warn claims are based on the fact that consumers may not know of potential dangers associated with using a product. For example, if a pharmaceutical company does not adequately warn the public of a drug’s potential side effects, this could lead to serious injury or death. In Maryland, all of these types of product liability claims have the same statute of limitations. This means that victims of product-related injuries have three years from the date of the injury to file a lawsuit. It is important to note, however, that there can be different requirements and limitations in different situations, so it is always best to consult with an attorney if you feel you have suffered harm as a result of a defective product.
