What are the elements of a strict liability product liability claim?

In California, if a person has been injured by a product, they may have a claim against the manufacturer or seller of the product through a strict liability product liability claim. In order to have a successful product liability claim, the plaintiff must be able to prove the following elements: 1. The product was defective in design or manufacture. The plaintiff suffered damages from the injury. 4. The product was still in the same condition it was when it left the manufacturer or seller. When bringing a strict liability product liability claim in California, a plaintiff must be able to prove that the product was defective when it left the manufacturer’s or the seller’s possession, that the defect caused the plaintiff’s injury, and that damages were suffered as a result of the injury. If the plaintiff can prove all of these elements, then they may be able to recover damages from the product manufacturer or seller.
