What is the Restatement Third of Torts?
The Restatement Third of Torts is a tool used by courts in Michigan to determine whether a product is unreasonably dangerous and should be subject to a Dangerous Products Law. This tool is used to determine whether a product was made with a design defect, a manufacturing defect, or if the product was deemed unreasonably dangerous from the start. The Restatement Third of Torts focuses on the concept of ‘strict liability’, which states that a product is responsible for injuries or damages, regardless of whether the manufacturer was negligent in the making of the product. This means that any defect in a product can lead to a case being brought against the manufacturer, and that the manufacturer will be held liable for any injury or death caused by a defective product. The Restatement Third of Torts is an analysis tool used to make sure that the manufacturer is being held responsible for any injuries caused by their product, and that all parties involved are receiving the proper compensation for their loss. In Michigan, courts may also use the Restatement Third of Torts to look at other aspects of a product’s design, such as warnings and safety instructions, to decide whether a product should be subject to a Dangerous Products Law. The Restatement Third of Torts can also be used to determine if a product is unreasonably dangerous in its intended use, which could result in a manufacturer being held liable for any harm caused by the product.
