What is the Restatement Third of Torts?

The Restatement Third of Torts is a set of legal principles that was established to help govern the liability for physical and economic harms caused by dangerous products. The restatement was created by the American Law Institute (ALI), a professional organization of lawyers, judges, and other legal professionals who develop and publish legal principles and standards in the United States. The Restatement Third of Torts sets out the general principles for evaluating the liability of a manufacturer of a dangerous product. The Restatement recognizes that manufacturers can be held liable for harm caused by their products if they fail to: use reasonable care in designing and manufacturing the product, provide adequate warnings about any potential dangers associated with their product, inspect their products at all times, and take all reasonable steps to make sure the product meets safety requirements. The Restatement Third of Torts applies to product liability cases in New York. This restatement sets out the general principles of how various parties, including consumers, manufacturers, and suppliers, are liable for the harms caused by a dangerous product. It also sets out the standard of care owed by the manufacturer and other parties involved, and how damages can be recovered. By following the guidelines set out in the Restatement Third of Torts, manufacturers can avoid liability for the injuries their products cause.
