What is the Uniform Product Liability Act?

The Uniform Product Liability Act (UPLA) is a state law that governs the liability of manufacturers, sellers, and distributors of dangerous products in North Carolina. The UPLA indicates that entities that create products for the marketplace are legally bound to make sure those products are as safe as possible. In the event that an individual is injured or killed due to a dangerous product, the UPLA provides a unified set of rules for how the claim can be argued in court. Under the UPLA, manufacturers are liable for any damage caused by a product if it has a defect, was not case-labeled properly, or was not safely packaged. Sellers and distributors are liable for any damage caused by a product if they were aware of the defect, if they had reason to know of the defect, or if they intentionally misrepresented the product. A seller or distributor can also be held liable if they failed to adequately warn about the potential risks of using the product. The UPLA is also applicable to products that make use of components from multiple manufacturers. In that situation, each manufacturer is liable for any damage caused by their component even if the damage is traced back to a defect in a component from another manufacturer. This law is designed to protect consumers from being harmed or killed by dangerous products in North Carolina.
