A statute of limitations defense to a product liability claim is a type of legal argument in which a defendant attempts to avoid liability for a product-related injury or death by arguing that the plaintiff waited too long to bring the claim to court. This defense is based on the statute of limitations laws established in each state. In New York, the statute of limitations for product liability claims is three years from the date of the injury or death. The statute of limitations defense is routinely used in product liability cases.
